1. Agreement to Terms
By accessing or using TalkToLawyer ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
TalkToLawyer is a technology platform that connects individuals seeking legal services with licensed legal professionals. We are not a law firm and do not provide legal advice or legal services.
2. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement.
For lawyers: You must be a licensed attorney in good standing in at least one jurisdiction to create a lawyer profile and offer services through our Platform.
3. Service Description
3.1 For Users
TalkToLawyer provides a platform to:
- Search for and view profiles of licensed lawyers
- View lawyer availability and book consultations
- Communicate with lawyers regarding your legal matters
- Pay for consultation services through our Platform
3.2 For Lawyers
TalkToLawyer provides tools to:
- Create and manage professional profiles
- Connect Google Calendar or Microsoft Calendar for availability management
- Set consultation pricing and availability
- Receive booking requests with client intake information
- Manage scheduled consultations
4. Account Registration and Security
To use certain features, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.
5. Calendar Integration
When you connect your Google Calendar or Microsoft Calendar:
- You grant us permission to access your calendar data to check availability and create consultation events
- You can revoke this access at any time through your account settings or directly through your Google/Microsoft account
- You are responsible for maintaining the security of your calendar account credentials
- We will only use calendar access for scheduling functionality as described in our Privacy Policy
6. Fees and Payment
6.1 User Fees
Users may be charged:
- Consultation fees (set by individual lawyers)
- Optional convenience fee for booking services (currently $5.90 per booking)
All fees will be clearly disclosed before you complete a booking. Consultation fees are paid directly to lawyers through our Platform.
6.2 Lawyer Fees
Lawyers are charged:
- A per-qualified-booking fee ($20–$75 depending on service level)
- Fees are invoiced monthly for completed consultations
- Payment is due within 30 days of invoice date
6.3 Refunds and Cancellations
Cancellation policies:
- Users may cancel up to 24 hours before a consultation for a full refund
- Lawyers should provide at least 24 hours notice for cancellations
- The convenience fee is non-refundable unless the lawyer cancels
- Disputes should be reported to support@talktolawyer.ai within 7 days
7. User Conduct
You agree NOT to:
- Provide false, misleading, or fraudulent information
- Impersonate any person or entity
- Use the Service for any illegal purpose
- Harass, abuse, or harm other users or lawyers
- Attempt to circumvent the Platform to avoid fees
- Scrape, copy, or download user or lawyer data
- Reverse engineer or attempt to access our source code
- Transmit viruses, malware, or harmful code
- Interfere with the proper functioning of the Service
8. Lawyer-Specific Terms
8.1 Professional Responsibility
Lawyers using the Platform:
- Must maintain all required licenses and professional liability insurance
- Are solely responsible for compliance with applicable Rules of Professional Conduct
- Must conduct their own conflict checks before accepting clients
- Are responsible for all legal advice and services provided to clients
- Must maintain client confidentiality and attorney-client privilege
8.2 Neutral Listings
TalkToLawyer displays lawyer listings based on neutral factors including:
- Availability (lawyers with open time slots rank higher)
- Practice area match to user query
- Jurisdiction match
- Ratings and reviews (when available)
- Distance from user (when provided)
We do NOT provide recommendations or endorsements. Lawyers do not pay for higher placement beyond standard booking fees.
8.3 No Fee Sharing
We do not take a percentage of legal fees charged to clients. Our fees are solely for lead generation and scheduling services, in compliance with ABA Model Rule 5.4.
9. No Attorney-Client Relationship
Important: TalkToLawyer is a technology platform only. No attorney-client relationship is formed between you and TalkToLawyer. Any attorney-client relationship is solely between the user and the individual lawyer they engage.
We do not provide legal advice, review legal work, or make legal recommendations. All legal services are provided independently by licensed lawyers.
10. Disclaimers and Limitations of Liability
10.1 Service "AS IS"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Guarantee of Results
We do not guarantee:
- The quality, accuracy, or completeness of lawyer profiles
- The availability of any particular lawyer
- The outcome of any legal matter
- That the Service will be uninterrupted or error-free
- That calendar synchronization will always work perfectly
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKTOLAWYER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR (B) $100.
11. Indemnification
You agree to indemnify and hold harmless TalkToLawyer, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights
- Any legal services provided by lawyers (for lawyer users)
12. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and design, are owned by TalkToLawyer and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of our Service.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, available at /privacy. Please review our Privacy Policy to understand how we collect, use, and protect your information, including calendar data.
14. Third-Party Services
The Service integrates with third-party services including:
- Google Calendar and Google APIs
- Microsoft Calendar and Microsoft APIs
- Payment processors
- ChatGPT platform
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions, content, or policies of these third parties.
15. Termination
We may suspend or terminate your account and access to the Service at any time, without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users or lawyers
- Is harmful to TalkToLawyer's business interests
- Violates applicable laws or regulations
You may terminate your account at any time through account settings. Upon termination, your right to use the Service will immediately cease.
16. Dispute Resolution
16.1 Informal Resolution
If you have a dispute, please contact us at support@talktolawyer.ai first. We will attempt to resolve the dispute informally.
16.2 Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive your right to a jury trial or to participate in a class action.
16.3 Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the new Terms on this page
- Updating the "Last Updated" date
- Sending an email notification to your registered email address
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19.2 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19.3 Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and TalkToLawyer regarding the Service.
